Terms of Service

These terms govern your use of the Escrofy app and website (the "Service") operated by Escrofy ("Escrofy", "we"). By creating an account or using the Service you agree to them.
1. What Escrofy is
Escrofy is an online marketplace. Sellers list items; buyers purchase them. Escrofy is not the seller of items listed by others and is not a party to the sale contract between buyer and seller. Escrofy is not a bank and does not provide deposit insurance.
2. Buyer protection — how payment works
When a buyer pays, the payment is collected by our payment processor (Stripe for cards, Safaricom for M-Pesa) and held. It is released to the seller when the buyer confirms delivery, or automatically when the inspection window closes without the buyer reporting a problem. If the buyer reports a problem in time, the payment stays on hold while the dispute is reviewed, and may be refunded. A buyer may cancel until the seller has shipped, and the payment is refunded less the platform fee. Platform fees are included in the price you see before you pay, and are not refundable unless the law requires it.
3. Accounts
You must be at least 18 and provide accurate information. You are responsible for activity on your account. Keep your email account secure — one-time codes sent to it sign you in. You may delete your account at any time (see Delete your account).
4. Sellers
Sellers must describe items accurately, ship within the stated time, and honour the buyer protection above. Sellers are responsible for their own taxes and for complying with the laws that apply to what they sell. Payouts are made to the payout method the seller registers.
5. Prohibited items and conduct
You may not list or sell anything illegal, counterfeit, stolen, recalled, hazardous, or that infringes another person's rights, and you may not use the Service to launder money, defraud anyone, harass anyone, or evade our fees. We may remove listings and suspend or terminate accounts that break these rules.
6. Content you post
You keep ownership of the photos, videos, listings, reviews and messages you post, and you give Escrofy a licence to host, display and distribute them to operate and promote the Service. You must have the right to post what you post. Do not post content that is unlawful, sexually explicit, hateful, violent, deceptive or that exposes someone else's personal information. Anyone can report content or a user from within the app or by writing to support@escrofy.com; buyers and sellers can block each other in messages. We review reports and may remove content or suspend accounts.
7. Disputes between buyers and sellers
Report a problem from the order screen within the inspection window. We will review what both sides tell us and decide whether the held payment is released to the seller or refunded to the buyer. Our decision is final as far as the held payment is concerned; it does not limit any legal rights you have against the other party.
8. Availability and changes
We may change or discontinue parts of the Service and update these terms. If a change is material we will tell you in the app before it takes effect; continuing to use the Service after that means you accept it.
9. Liability
To the extent the law allows, Escrofy is not liable for the acts of buyers or sellers, for items sold by others, or for indirect or consequential loss. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract.
10. Governing law
For accounts registered in Kenya these terms are governed by the laws of Kenya; for accounts registered in the United States, by the laws of the State in which Escrofy is established, without prejudice to mandatory consumer-protection law where you live.
